Orders Placed on the Site:

These terms and conditions are incorporated into every purchase made on this site, and User may only order products on this site upon acceptance of these terms and conditions. Upon placing an order, User agrees to pay the price of the product plus shipping charges as well as sales tax, when applicable. TOL reserves the right to decline your order for any, or no, reason, and TOL further reserves the right to terminate the usage of this site by any User. Cancelled orders will be treated as returns and will incur identical penalties.

Delivery and Non-Conforming Products:

As TOL secures its products from a number of different manufacturers that ship via a number of different carriers, TOL does not guarantee shipping times. It is the User's responsibility to make sure that the goods are in compliance with their order at the time of delivery. If the goods are not in compliance or are damaged, User must refuse delivery of items at the time of delivery. Acceptance of delivery is considered as an assertion by User that the goods are in compliance with the terms of the order. Any problems discovered after acceptance of delivery may result in additional expense being incurred by User.

Cancellations and Returns:

If there is any defect or problem with the item, please contact our customer service department within 24 hours of receipt of the item and we will ensure a replacement item or full refund.

Product Assembly:

In order to reduce delivery expenses, many products come in unassembled, or partially assembled form. Assembly of such products is the User's responsibility. Not all products requiring assembly are marked as such on the Site. For any questions or concerns, please contact customer service.

Warrantees:

All products come with full manufacturer's warrantees. Users wishing to invoke manufacturers warrantees are to deal directly with the manufacturer. Except for this, there are no other warrantees, either express or implied.

Limitation of Liability:

TOL's liability to User and any third party is limited to the price paid by you to TOL for products purchased through this site. Under no circumstances shall TOL be liable for any lost profits, or special, incidental, or consequential damages, however they should arise.

Dispute Settlement:

Any dispute relating in any way to your usage of this site shall be settled in accordance with the laws of the state of Delaware.
